Insurance EOB's for proof of medical bills

What is the name of your state? NY - Two questions, please...
1) Can we use our Explanation of Benefit statements from insurance as proof of medical bills?

2) We would like to petition for arrears for % of medical bills that has never been paid by ex-wife. After original settlement (her paying 30%) she made a deal with my husband that he didnt have to pay child support ($100/mo) and she would not pay for medical bills. This was fine for 4 years - but she has now petititioned for arrears and additional child support. So we would like to petition for back med. bills payments. Is there any statute of limitations in NY?

1. Probably, but why not just provide receipts with proof of payment?

2. If your husband was court ordered to pay child support and the two of them made a side deal, she will easily win this one. He will also easily win the back medical bills issue.
