What is the name of your state? WV
What happens if the one paying child support has to do jail time and can't pay? It doesn't have anything to do with CS. Would the mother get Social Security for the child? Do arrears occur?

Unless you try to get it suspended, child support will continue to be due and owing and will be in arrearage until you get out and pay.

You mean the jail time is for crimes other than nonpayment of support?

Doesn't matter. Dad should have thought of his child/ren before committing crime/s that sent him to jail.

And the kid is still hungry. Amazingly.

Actually, there was a post here the other day in which upper courts have held that incarceration is an INVOLUNTARY unemployment.

Yes I have heard of judge's suspending CS temporarily during incarceration. However, that can only happen IF Op files to modify the child support prior to going to the pokey. Otherwise he will owe according the most recent order.

Why would you think the mother would get social security? Dad's not dead, he's just in jail.
