To late for paternity test?

Not sure what to do and what our rights or option are at this point.
My husband has a 19 year old son who lives in New Mexico near his ex-wife. Since day one he had always had doubts whether he is really the father of their now 19 year old son. The reason why they divorced is because he suspected she was cheating on him with her ex-boyfriend.

The reason why he does not think he is the biologial father is because they look nothing alike and to make matters worse, his son actually looks like his ex-wifes old boyfriend. The one he thought she was having an affair with.

He has attempted many times to have a relationship with his son and it has been near impossible. In the past 13 years his ex has been married and divorced 6 additional times and only calls him when she is getting a divorce to see if we are still together. During this time she has moved around and changed her phone number dozens of time which made it impossible to keep in touch with his son.

The concern is recently he received a phone call from his ex-wife after about 2 years to let him know his 19 year old son is about to became a father himself. When my husband talked to his son we found out that he is now going by his mothers maiden name and not his last name. Not to mention his son's child is also be going by this same last name.

He owes quite a bit in back owed child support to the state and is more than willing to pay the back owed child support if he is indeed the biologial father. He truly believes in his heart that he is the biologial father.

Part of this is our fault by not looking into this sooner, however at the time we felt we were doing what was best for his son. He has had a very unstable life and we have always told him the door is open if ever needs anything. That door will always be open for him whether he is the father or not.

Is it too late to have a paternity test to verify that he is indeed the father even though the child is now 19?? My husband is terminally ill yet is still healthy enough to keep working. However our finances are very strapped with all of his medical bills.

What state is the custody agreement/jurisdiction? If it is New Mexico, there is until age 21 to test. If there is paternity fraud by the Mom that may cancel out the arrears, which may also be canceled upon his death except for assets of his estate, so it would be a wise idea to get this question settled now. He could get a private DNA test, this is less expensive and only requires the cooporation of his son and if he is not the father, petition the court for a DNA test with Mom paying the costs and other petitions as needed to resolve the issue, it would be best to have an attorney help with all this as it could get nasty.
