    My ex owes me past due child support potential contempt

    What is the name of your state (only U.S. law)? Minnesota

    I have been divorced since 1997. My ex husband has routinely NOT paid child support and currently owes me a whopping $85,000 in past due child support. He works part time at the Army reserves, so I might get $75.00 in 1 month.

    We had a motion to show cause hearing on February 14, to determine if he was in contempt or not for failure to pay. During the hearing my ex husband and his attorney stated that my husband as re enlisted in the Army Reserve for another 6 years making him entitled to a 10,000 enlistment bonus. My ex stated he would "give" me the entire $10,000 in order to NOT be held in contempt.

    The judge signed the order and it has been sent to the DOD. In reality what is the likelihood that I will really get the 10K. He is entitled to it, will the DOD just send it to the state who will send it to me.

    I doubt anyone here can tell you that. Have you asked your lawyer?

    ...those enlistment bonuses are generally "staggered", too...did he tell you that?

    I was told that the bonus was available 6 months after the enlistment date, so not until mid August. I had thought they were staggered also. I did read that they do not right checks for more then 10K so it would be in two parts.

    I am not sure who to check with on that though. The ex isn't terribly helpful.
