    Need Advise

    What is the name of your state? NC/CA

    My husband is in the Marine Corps we are stationed in NC. He has a child with an ex in CA. He is currently deployed. He was paying her 300 a month without court orders. She found out he was married and now is asking for 700. He will be back soon and will not make much. She has started filing with the court. The child does not have my husabands last name nor is he on the birth certificate. Can she get child support? Can she get that much money? What can we do? Can he have visitations? Does it matter that we are in 2 differnt states? Please help!!!!!!

    Yes, she can get support. He would need to be legally found to be teh father, either through voluntary acknowledgement or through a DNA test. It's impossible to even guess what the amount would be without knowing his and her income. It's possible that the case won't be heard until he is back in country.

    Yes, he can get visitation. He would have to file for it.
