Hi everyone..
I will do my best to make a loooong story short..
About 12 years ago I was taken to court by a girl who claimed I was the father of her son-we were both in high school at the time, however I have just turned 18 a few months before..
Not knowing what the heck to do, and even though I was hearing all kinds of things about who was the father and how I wasnt, there I was in court -alone- and just wanted it 'over' with.. so I ended up signing what I didnt know at the time and found out later was the acknowledgment of paternity.
After all that, we agreed I'd give her $ when she needed it, more or less..
In all that time I had given her some moeny here and there and saw the child maybe a total of 10 times-mostly when I would drop off money, absolutely no relationship with him, not even sure he knows my name..
So fast forward to the past few years, I felt I needed to chage things in my life and decided to find out for sure if im the dad, and go from there.
(in the meantime, she has been on social services and voila! im in the system and they garnish my check, always for more than the 17% allowed.. only to take weeks and weeks to adjust it... but i digress...)
Results come back, im not the father.
We go to court, testify and the whole 9, the mother is on 'my side' in that she testified she wants me not to be help responsible and take me out of the picture all together, but its not her case technically, its the state, and they wont let me go, regardless of the DNA test..
She then vacates the order of support a few months ago, as she was not on the system at the time, finally I get all of my check!!
she just called me today and said shes deciding to go back on.. and to check with my lawyer to see what that will mean and if theres any way to work it so they wont garnish my check for support again.. yeah right..
she has some kind of boyfriend , theyve been together for a while and i believe he lives with her.. and he supports them somehow..
she has no clue who the real father is..
its my basic understanding that unless she can fill in the blank where my name is with the real father or an adoptive fathers name, im screwed till hes 18 or she can stop going on and off the system..??
what are my options here.. ? there must be something i can do so im not penalized everytime she decides to quit her job and live off the state...
please help! im at my wits end.. i have a lawyer, but of all the ones ive consulted with and talked to, 90% throw theyre hands up to the state and sy it is what it is.. the state is the issue apparently..
