    Paying CS and receiving SSD

    What is the name of your state? New York
    My child support payments were being deducted from my paycheck, I recently became disabled and now receive SSD benefits. I understand that a child is entitled to 50% of my SSD benefits, I have 3 minor children only 1 open child support case and a 20 year old in college who I also support (although he is not eligible for SSD beneficiary payments based on his age).
    My question is the following: When I go to have the support order modified, will the benefit for my child (whom I have the open CS case for) be counted as child support, or will I have to pay an additional amount based on my SSD income. The mother is now working and makes more than I do.Also I may be entitled to a small amount of back SSD, will the judge make me pay back child support due to this money (I presently only owe 80.00 in arrears)

    I am also planning on moving out of state (for health reasons) do I have to open a case in that state or is the order from NY good.

    The Judge may or may not order additional CS payments on top of what SSDI issues .

    It should be no more that 50 bucks m if He/She does .

    If you receive back pay Just pay what you owe out of it .

    As long as the Child resides in NY , that's where you will send the payments .
