SSDI & Child Support


What is the name of your state (only U.S. law)? Colorado
My ex has physical custody of my daughter due to my bipolar disorder, but i have visitation right which includes overnights now. He says he will take me to child support court, which is fine, i have no problem tryin to provide for my daughter, however, i recieve SSDI, and was wondering if he tries to file for benefits under my name for my daughter, can he also get child support on top of this? Thanks for your replies.

Yes it is possible. And I thought he got custody due to the fact that you were in the hospital possibly DYING! Now you say it is due to bipolar disorder? I am confused.

your SSDI will replace your child support, Pearl. when you are served with child support, make sure you inform the court of your SSDI.

It might NOT replace it completely. Many times it does but sometimes it does not.

I just wondered because if he goes for child support out of my check, he will only get 75 dollars a months, and if he does the benefits for my daughter, he would get 300 per month. I would think he would want the larger portion to help support my daughter, or at least that is what i prefer, so that she gets the maximum benefit under my ssdi.

Isabella - I wasnt allowed to see my daughter for 5 months til i was stabilized with the right meds, and could show the courts i was not a danger to my daughter, i just barely got visitation with her 3 months ago, supervised, and now have her unsupervised a few times a week, and every other weekend for an overnight.

go back to the SSA office, put down dad as the benficiary, with his address as her home address. they will mail him the check.

Pearl, i am very sorry for what you are going through. keep working on you, keep working on your relationship with your daughter. but in this instance, you are no good to her, unless you are good to yourself. so, you have my best wishes.

When my SDs mother got SSDI, my husband starting receiving CS. It was only $150.00 per month, but it really helped out.
