Does the amount of support paid depend on living expenses? My best friend is worried because he got some one pregnant. He feels like he wont be able to support himself if child support is order based on income. So does living expenses like rent & student loans play a part in amount ordered? Also is it best for him to file support on himself or wait till she does it? Or does it matter who does it? Thanks! Really would like some advice to tell!


Also what advice do you guys have on what to expect and what are some boundaries he should set. He basically feels like he will be taking orders from this person (at least until the child turns 18). (He fears child support that much!)

Child support is based on income.

Before any sort of support order is entered, paterrnity would need to be proven - I'd urge him to insist on a DNA test. Once he's proven to be the father, he'll have the right to file for visitation or custody should he choose to.

If he "fears" child support so much then he should have thought about the consequences of his actions beforehand and used protection. Regardless, once the child is born, he/she will have basic needs like anyone else.....food, clothes & shelter. It is the responsibility of BOTH parents to provide for the child. Yes, child support will be based on his income.....regardless of his own rent or student loans. He will now have a child to support, and if that means he has to live somewhere cheaper or cut down on his school hours....then so be it. Everyone has to make sacrifices. If he knows it is his child, then he has a moral obligation to help support the child from day one. However, he is not legally obligated until paternity has been established. He can ask for this or wait until the mother asks for it. He will not have to take "orders" from the child's mother at any time......the courts will determine custody, CS, and visitation and this is what he must follow.
