    What is the name of your state?I am a mother of 2 who should rec. $2000. a month child support, my ex husband decided in April to stop paying, I have changed jobs and am making decent money but can not afford to make it alone, we have shared joint custody but my daughter has not been with him since April and would like me to take full custody and our son's time has since become every other weekend. My ex lives with his girlfriend who is financially supporting him which is her choice but he refuses to support his kids, he worked in the television industry and made great money and now was not resigned for 2 top shows and is selling sporting goods with the income not being reported. I am unsure how to file paperwork for the custody change or the support.
    But am frustrated that he has the $ to golf but not pay for braces/Drivers training or food????Can any one suggest how I can get started I can not afford an attorney and child services said it could take them 3 to 6 months?

    As for the support issue, you can file contempt of court for non-payment of child support.

    Is he court ordered to pay 1/2 of orthodontia and/or medical expenses? If not, he's not obligated to pay them. Also, why would he pay for drivers training and food? They are part of child support unless the judge has specifically ordered that he pay child support AND pay for drivers training and food.

    I think she meant that because he is not paying his child support he is not paying for those things.

    California - Yes, He is responsible for 1/2 of the ortho and extra curricular activities as agreed in our divorce papers. I have been paying for the health insurance which is also something he is supposed to pay for in our paperwork.
    He doesn't need to pay the spousal support at this time, I just would like some sort of help with our children. I can not afford an attorney where do I go to file contempt of court papers and do I need an attorney to do this? Support services said it could take 3 to 6 months once the paperwork was filed through them and he is already behind $12,000. (6 months). Any advice???????????

    Support,California. In addition to the previous posting can anyone tell me if my daughter (16)would like to live with me full time and I file for full custody does this mean her father does not have to pay support, I was told by a few people that by taking full custody I was giving up support. I am unsure if not seeing her father at all is the best thing for her but the full custody option is something we have discussed, her brother 13 is with his father every other weekend.
    I am unsure of what the outcome of filing contempt of court will be, jail? wages taken? etc. and is this something different then filing with child support services?

    The sooner you file contempt, the sooner you can get the court date. Your county should have the paperwork. You don't need an attorney but if you don't know how to properly fill out forms, file them and have him served, you are better off getting an attorney.

    Your daughter can wish to move in with you full time all she wants, but until a judge orders it, the current order stands. No, he would not get out of paying support, you would not give it up. Even if you got "full" custody, he would still have court ordered visitation.

    It's up to a judge as to the consequences of one contempt action.
