My fiance has a 5 year old. Her ex-husband hasn’t paid child support in over 15 weeks. She has filed a complaint with the court because he does not pay through the court system. She has been given a court date and we have now sought legal advice. Her papers initially stated that if he was over 5 days late, he would have to make payments through the court system. When she filed however, she was told that since he lived in another county that we would have to go back to court. We are now being told by our attorney that when we go back to court everything will have to be retried. Is this true?
