unpaid hospital bills

Can my husband who is custodial parent sue NCP for unpaid hospital bills that are on his credit. Child had medicaid but mothr never gave info there fore bill was never paid. Medicaid wil not pay it now due to it being 2 yrs old. Does he have to pay the bill first and then sue for half of the bill that he paid. Isnt she responsible for 50% of everything that has to do with child? Is this a small claims issue? Thanks you
 


there is a court order but it only says that ncp is responsible for monitary obligations to the child. Mom never showed and lost by default so child sopport was never issued. CAn he sue?
 
Child support was never an issue? Does that mean she doesn't pay child support at all?? You would need to state the actual language of the CO so that we can see what kind of "monitary obligations" you are speaking about...
 
there were never any court orders until mom took child from dad and kept him from his father for over a year. So dad got a lawyer and established paternity and went for primary care. He won by default. Therefore the time mom did have child she recieved welfare. But at the time of the hospital bills child lived with dad and child got sick dad took him to hospital and when child was transfered from the hospital to an all childrens hospital mom was the person who filled out papers for medicaid and everything went in her name from that point on. But the initial visit to the first hospital was all in dads name. Thats how the bills are in his name. Dad new that the child would get medicaid b/c mom doesnt work and so dad tried to get mom to give him info for the bills and she gave hima hard time and the run around. So 2 yrs later I find out child has mediciad through children and families i also have number but We are not using it because we have insurance on child but at the time of bills child had medicaid and they wont pay because it has been two years. So dad is paying the bills himself so isnt mom responsible for 50%.?
