What is the name of your state (only U.S. law)? Nevada / Oklahoma

I currently live in Nevada. the Child Support case is in Oklahoma.

This is a multi-part question.

I owe past child support, Not my child, but OK says they don't care I'm on the birth certificate. I have had multiple heart attacks and have been told by the doctors that I probably won't live to see my sophomore graduate from high school. I am trying to get assistance from Voc Rehab to get retrained into something I can do with my condition. I am now in arrears on back and current child support and unable to make payments. They have gone so far as to levy my bank account which is currently negative $800. When I was fired my employer falsified documents so I couldn't collect unemployment. When I found a lawyer to take the case they filed bankruptcy.

I do not have any income, My wife does not work (no one will hire her, been unemployed too long taking care of my son) my power, phone, water and everything else gets shut off in less than 3 weeks.

Do not get me wrong, I want to work I am willing to pay the child support for a child that is not mine (DNA proves it, and I have not seen in atleast 10 years) But If I am not working I can't.

Since I am in arrears on child support will I lose my Vocational Rehabilitation support? Can my wife still collect welfare for us and my 5 yr old? Do I need to divorce my current wife and live on the street so she can get some help until she can get a job?

You should have filed for a modification as soon as your employment circumstances changed. Do it now before your arrears get any bigger.

I have tried and tried to do a modification. When I was working even though it was less, I tried to modify. I called and called, OK told me I had to go to OK and request the modification. I finally had to call the governor's office to get assistance. Then they took over a year to finally modify it.

I can't go to OK. Hell my mother died on August 2nd of this year and I couldn't afford to go to the funeral. That is how bad things are for me.

I really don't care if I go to jail any more, I just want to ensure that my current wife and son are taken care of. If I go to jail, due to the medications I am taking to keep me alive, and not getting them 4 times a day, I won't live longer than 6 months.

Good. Then go to jail. COntinue being a deadbeat. You could have questioned paternity on this child years ago and did not. Hence, you are daddy and are responsible for support. And the jail would have to give you your medications while you are in there. Why wouldn't you get them?

This is the time of year that your wife should start looking for seasonal work - even with the economy down, most retail places hire for the holidays. NOW is the time to start looking. Being a SAHM for 5 years isn't an excuse, to be honest. And now that your son is 5, he is presumably going to be going to school, so her availability is increased - you can watch the kid before/after school while she works. She should be applying anywhere and everywhere, even if it's Walmart, McDs, BK and the like, regardless of the shift.

Agreed that you should have done something about paternity long ago, but you didn't, so such is life. The child is legally yours, and therefore should be supported by you. Where you erred in trying for a modification is in making phone calls - that does nothing. You had to actually file for anything to be done. I would suggest that you start googling ASAP for OK information and how to file from where you are - including asking for a waiver of fees due to your financial situation.

You also need to call the utilities and see how they can work with you. Many will work out a payment plan in cases of financial hardship.

But as single317dad posted - you're the one who needs to take action.

ETA: Depending where in Nevada you live, and assuming that they are similar to the ones in AC - the casinos are ALWAYS hiring.

Voc Rehab doesn't provide living expenses, just mostly training expenses, and usually that is only while you are actively engaged in the training you have been approved for.

From the sound of things, you do not think you are not healthy enough to enter any kind of training. I question whether they'd be willing to invest in a client who was this near death. What would they train you in? I suspect perhaps you're not really enrolled and admitted to any of their retraining programs yet, this is just a consideration.

But needs based money, either "welfare" or voc rehab training alotments don't get used to pay child support. Since it's based on your having genuine need, being genuinely low income, there's really no point in trying to get blood out of the proverbial turnip, is there? Putting you in jail would simply provide you with a place to stay and meals at great expense to the state, and your family would still be on assistance.

What assistance is your family receiving right now? Are you being sanctioned because you were fired from your job? Have you or your wife refused to participate in re employment programs? Have you begun the process of applying for disability? If you're really so fragile you're going to die before the leaves fall from the trees this year, you should begin this process at once.

Can the drama about getting a divorce and going on the streets, if you can't afford anything else, you can't afford a divorce either. I agree that one or both of you should be looking for a job. Voc rehab can't re-train you as a pie taster or a mattress tester, which sounds from your description is about all you're physically able to do. But you could take care of your children while your wife worked.

As someone pointed out, your posts are one huge whine about how the system is out to get you. You've been asked to pay child support on a child that isn't yours. You can't get a modification on this.

You were fired from your job. The employer lied, said something awful like that they really did have a good reason to fire you. The unemployment system determined they had a valid reason. You did not get approved. You do not need an attorney to get unemployment benefits if you are really qualified for them. And if you had been approved, the employer going bankrupt would not have stopped you from getting benefits, as benefits do not come from the employer's pockets, but from the states' general unemployment funds.

Now that you've gotten all this off your chest, played out the dream of just dying and making them all sorry, it's time for you to man up here and figure out how to get along and meet your obligations, survive in the world a bit longer. No, if you get into a voc rehab retraining program, they will not take that money to pay back child support.

The major problem with getting hired at casinos would be being able to pass a background check. Me thinks OP wouldn't pass. (Call it a hunch based on his way of posting.)

Well thank a few of you for answering my question. The rest of you need to stop taking your bad situations out on others as well.

I am trying to take care of business as it was put. But you can't get blood from a turnip. no matter how hard you squeeze. I don't want the state to pay $3,000-$5,000 to retrain me if I am going to go to jail because of not paying my child support in the meantime.

By the way commentator. I have been approved, and am supposed to start training on Monday. I am going back into the IT field. I have been out of it for seven years because I went into federal law enforcement, before my heart attacks made that impossible.

My wife is applying for jobs and so am I. Last night I sent my resume off to 5 companies out of the blue, and applied for 12 jobs that I found online. As a reminder I live in Nevada. Nevada is the hardest hit state with this economy. The county I live in is he hardest hit county in the entire state. For you brainiacs that means what..... I live in the worst county in the country... Very good you are smart.

As for getting the medication in jail. Having been in law enforcement, and taken criminals to jail, they don't always get the medications they need to survive in the proper doses and at the proper times, mainly due to costs. One of my heart pills is over $647.00 for a 30 day supply. My situation is all hereditary I am not fat. I am 6ft, 180lbs. No male in my family has lived past fifty in over 300 years. I can provide Genealogy records as proof of this. My father did a ton of research.

Again I do complain some about the situation, but Ohiogal I am not a deadbeat. up until 3 months ago when I had my third heart attack and second open heart surgery I have paid my child support. Never failing once. As for paternity. It wasn't until the child was 10 years old, that the mother told me that he wasn't mine, that he belong to the dude she married after me. I did do a DNA test, got the results back and sent those to an attorney in OK. Oklahoma's rules state that if a man is on the birth certificate whether or not he is the true father, he is responsible for that child until he is 18 or until out of school.
