What to do


What is the name of your state? New York
My 17 year old Daughter moved out of my house in February, 2007. There is a huge history of problems with her that I will not get into now. Only one required a visit to the Courts regarding an assault on a girl in school. Sentence was a fine and community service.

I have attempted help form state and county agencies as far as counseling, parental contract and school programs. None have helped.
Today, I get a letter from the courts that she is seeking child support from me. Totally blindsided by this.

Back in February she got a 2 day suspension in school for threatening a student. I imposed a weekend grounding as her punishment. Friday evening she proclaims she has plans and is going out. I announced "if you leave, don't come back". She has been staying at a girlfriends house since. Single mother w/boyfriend, her friend and friends brother. I was continueing to provide her health insurance until someone informed the Child Health program that she no longer lived with me and it was canceled. I assume it was her or someone involved in her new household. I registered her for summer school only to find she never attended. In my opinion, the above just helps to describe that her social life and not wanting to follow rules have lead to these decisions she's made.

Along with this Court paper is a signature from this friends mother as a Guardien ad litem. Apparently this woman applied for guardianship at the same time.

What legal rights do they have? What are mine? She will be 18 the end of November.

Emancipation of a minor in NY

A guardian Ad Litem ( GAL ) is an Attorney for a minor child in Court proceedings to represent the child .

Guardianship would be an order of the Court granting the care of the child to a person or Agency , other than the parent(s).

Who is seeking support ?

If your daughter is and you kicked her out of your home , you might be held liable to support her until 21 , however if she was out of control , don't attend school , you might want to try to claim she emancipated herself , so you shouldn't have to support her.

However you have the burden of proof , if she claims you kicked her out .

If someone was legally awarded guardianship , they might be entitled to CS for your daughter .

Be prepared to provide proofs to the court .

Did you file a police report listing her as a runaway? Did you file a complaint against the friends mother for HARBORING a runaway?
