20-25 minutes late


What is the name of your state (only U.S. law)? Baltimore, Maryland

The circumstances surrounding the case are extensive!! uuuuggghhhh**************.

I was scheduled for a merit trial today in which I was named the defendant. I called ahead of the court scheduled time and informed the clerk that due to single lane construction and minor traffic delays I would be about 20-25 minutes late (approx. 46 mile travel). She assured me that she would take it upstairs and inform the court. Finally I arrive 23 minutes late and watch a few cases go up before I could get the attention of the bench clerk. She called me over and handed me a judgment entered for $23.5k ,hand notated on the lower portion

That's why you seriously need to make sure you attend these hearings.

If the decision has already been made it's highly doubtful you have grounds for an appeal. Sorry.

Your chances are slim to none. Why? Because you were late. It doesn't matter why, just that you did not appear on time. If you had been in an accident or fallen ill and taken to the hospital, you MIGHT have a chance to appeal. But your lack of planning was not a good enough reason to be late to court.

As someone once taught me:
If you're early, you're on time.
If you're on time, you're late.
If you're late, its unacceptable.

You should have planned ahead to be in court far earlier than you needed to be to allow for unforeseen delays. At the worst, you might have had to sit a bit and wait your turn. At best, you would have made it to court in time for your hearing, despite the traffic.

The judge and court don't run on YOUR time, it is your obligation to run on theirs. Whereas some judges may be flexible, that's the exception rather than the rule.

This philosophy an rule is well known and credible in most perspectives. There is also an unspoken rule that no matter how much planning, sometimes sh%$#t happens. I had it all planned out upon receiving the notice. I was down with the swine flu for about 2-3 weeks and hospitalized for atleast half of that time frame. I think it was more lack of performance than planning. Maybe between the morphine, robtiusin w/codine, and vikaden, thing were still a little fuzzy. I sill don't feel it should cost me $23.5k! especially when I did not perform engage in the contract she is suing me for.

i'm wondering if a motion to set aside the default order would be of any use....seniors?

Please explain exactly what type of case this is, the evidence against you and your defense.
