What is the name of your state (only U.S. law)? Texas

We have a new construction company and have recently built a bulkhead for an elderly man. The damage to it was cuased by hurricane Ike. He agreed to 1/3 up front, 1/3 half way through it, and remaining at completion. We completed the project with $7000.00 remaining due which he is refusing to pay. His reason is because he could have had someone else do the enitre job for $19,000.00. We do have the agreement in writing.

  1. Do I have to have an Attorney send a letter to him with our intent to file a lien?
    Will I have to wait ten days before I can file a lien?
    Can I collect interest on the money owed to me?
Is there any other information you feel I should know?
