What is the name of your state?GeorgiaAfter a series of debt collectors coming against us in violation of FDCA, we were forced to file CH. 13. One particular debt collector filed a case against us in State court and we counterclaimed and filed to remove the case to Federal court. Federal court "terminated the origianal claim", but we also received an order deining removal to Federal court. Do you think the counterclaim is stayed in State court until the bankruptcy hearing on March 9th? At our 941 hearing the debt collector asked what we planned to do with the FDCA claim. Should we continue or wait to hear the stay has ended?
Thank you,
