What is the name of your state (only U.S. law)? Michigan

My daughter made a claim to her high school asst principal that the athletic director had made comments about her having a fat belly and also toughed her on her side near her breast. She was asked when and where this happened. After an investigation the school administration says this could not have hapened. They have accused her of making a false statement and that due to the severity she is being recommended for expulsion. She is a National honor student, a senior with only 4 credits required to graduate.

Can they do this since it is her first altercation of any kind with the school

What action have you taken regarding the alleged inappropriate contact? Have you contacted the police? Have you contacted the board of education?

They were unable to confirm her claim on there sevalience cameras. They also say that there cameras show that she was not in the area at the same time as the athletic director. Therefor they say this could not have happened. The only accusation was made to the assistant principal. We did not notify law enforcement or the Board. She is being brought before the board to be expelled.

Okay, so let's stop tapdancing around this.

If your daughter lodged a false claim, the school's actions are correct.

You are not saying whether or not it happened. Apparently, you believe that the accusation should be enough. It is not.

I believe she is telling the truth but can not prove her claim. She would have nothing to gain by lieing
Of course she might have something to gain. Attention, sympathy, revenge--there are any number of possible motives. Especially if he did make a comment about her weight that may have angered her.

More importantly, how does your daughter explain being somewhere else when the alleged attack took place?

It sounds like your daughter assumed that an accusation of sexual contact would remove a teacher she didn't like and it backfired big time.

My wife is a teacher... and an accusation like this is not treated lightly because it can color a teacher's career forever.

Your daughter tried to not only get a teacher fired but also to make sure that teacher could never teach again. If she was lying, expulsion is a proper punishment.

I can't even imagine what kind of hell it would be to suffer the consequences of an unjust sex offense accusation, especially if the alleged victim is a minor. Gotta disagree with you, cyjeff. If she was lying expulsion isn't nearly enough.
