So this means right now they have retreated but may come back? Can I use that has a defense also if they do return?

A: I don't know if they have "retreated" or not; all I guess is that they have dismissed it without prejudice.



Q: Can I use that has a defense also if they do return?

A: If they sue you again and want to dismiss it again, then tell the judge you want it dismissed WITH prejudice (magic words).
