A Friend in need


From Mass
I went to court with a elderly friend to get a restraining order against another woman who pointed her finger like a gun and than said you need to be F**king dead too when he went before the judge he said we are the mority we do things differently with his hands out than he brought them in and those people dont understand our ways mind you my friend is afircan..and the defendant is white.. Can she go and have the denied restraing order vacated or does she appeal it or what I dont know nowWhat is the name of your state (only U.S. law)?

He can refile the petition but it appears that he'll need more evidence to prove a legitimate threat.

Is that what you were asking?

the elderly person had police report and a report from the security gaurd here in out building ..what kind petition can we do and how do we not get the same judge

You need to be a little clearer.

Please explain why a different judge would be necessary - does your friend believe he was discriminated against? Treated unfairly for some reason? What reason?

What does the police report say?

Did your friend seek an attorney? What exactly is your involvement? (the use of "we" begs the question)

The Judge, the clerk and the bailiff knew the woman who went with the defendent ..the plaintiff was told by the woman you need to die too and she made to shoot the the plaintiff with her fingers.Im just a friend of the defendant and try to help her out .. and when a Judge say we are the morinty we do things differently than looks at the plaintiff and those people dont understand our ways I believe there was a problem with the judge for doing that ..I just want to know how to go about getting a restraining order for this person so she can live in peace..

Yes you explained this already.

But I'm just not seeing where the Judge did anything wrong - can your friend prove that she felt the threat was genuine and not just an outpouring of silliness or inappropriate humor?

Oh the threats are real , she was going after the plantiff when she said everything to her and the security gaurd wrote the report explaining that ..

Sorry for my spelling Im not a great spell

Secuirty gaurd filled a report out that goes into the building managers office and she got a copy of the report from the office and brought that with her ..this other woman is a bully in the building ..I know since I had to get a restraining order against her and many are afraid of her and her husband ..my question can my friend appeal it or try motion to vacate the denied restraining order

There is nothing to vacate. You were told at the beginning, if your friend wishes to get this restraining order s/he needs to satisfy the requirements. She has not done this.

And, as I believe was advised earlier, have your friend consult with an attorney.
