Hazardous property fence

What is the name of your state?What is the name of your state? GA

Our neighbors built a stockade fence. Even though it is on their side of the property line, the nails from the fence boards protrude through the rails of the fence, sticking out about a half of an inch. One of our two dogs has already been scraped by these nails, not requiring medical attention.

My question is: If one of our dogs is seriously injured and requires medical attention is the neighbor liable? We have asked them on several occasions to correct this problem and they have refused.

go take pics of the nails sticking out and call your city hall to see if they required a permit for the fence and mention the nails and see if this is anything they can look into .

As long as this is on their property, there is nothing for them to fix.

Keep your dogs inside or, if outside, on a leash.

**A: if the nails are within their property line, you have no claim. The dogs are just going to have to be a little more careful.

Was this fence constructed to proximate the property line? if so you can send a regestered letter saying something like,the fence was constructed in a manner that is poseing considerable danger to anyone comming onto your property.Especially young children,or animals.If you do not remove the hazard you will have no other option than to construct a fence in front of it so as to make safe your property.At their cost...Maybe you could even ask for permision to nip off the nail tips yourself.(get it in writing) the main thing is to make it safe right,Then if they do nothing build your fence and take them to court for the cost of your fence.,as they caused your property to become unsafe.and built thier fence with total disreguard to the your saftey.Your letter shows you tried to work it out before going to court.The judges like that stuff. ;) Good luck..
