I have a date for a case management conference which I'm trying to reschedule. In a previous post

I have have gotten some valuable information about what the purpose of a CMC even is: http://www.courts.ca.gov/1306.htm

I know the best advice is to get a lawyer but as of now I'm not to confident, at I would be able to affort an attorney and since the plaintiff is communicating with me and willing to maybe settle out of court that money might be needed to make some payment arrangements.
As of now I'm trying to take action myself as far as i can but if it comes to the tail or even before



I'm also trying to move the date but Form CMC Statement only asks to list dates on which I'm not available for the actual trial.

You are not entitled to a public defender for a CIVIL case. Why do you think you would be?

The reason, I even needed a public defender , is because besides the financial dispute over the business deal, I'm being accused of fraud, which sounds like it would be a criminal case and I think that would entitle me to a public defender .

It's only a criminal case if the STATE charges you. As long as it's an individual/corporation that's suing you it's civil no matter what they allege you did.

step 1. establish yourself in a position in life where you have nearly no value to your estate
step 2. commit a crime....in California....of which there is a possibility of incarceration


step 3. get arrested
step 4. when arraigned, request a PD



If you were successful in 1, 2, and 3, you will be given a PD.




fraud can be a civil or criminal matter. If it is the state charging fraud, it is criminal. If it is within a civil suit, it is not a criminal matter.

can somebody tell me how to move a date for the case management conference without a lawyer ?

File a continuance and give your reason why in the motion. You may have to include an order.

The time is not good and it will give me more time to prepare . ( I have been talking to the plaintiff outside of the lawyer / court ) thats when I thought we would settle out of court.

You may get an extension, but you might not. Even if you do, don't expect more than one extension based on these relatively flimsy reasons.

@zigner I understand, do you know what forms to fill out and submit for an extension ?
I don't know offhand but California does a pretty good job of listing forms available when you go to their websites.


There is not necessarily a form for everything though. Sometimes you simply write your own motions and such. If that's what it is, make sure it conforms with any requirements of the court.
