Husband's creditors want to be paidWhat is the name of your state (only U.S. law)? NC My husband recently passed, and now I'm getting hounded by his creditors. As executrix, can I have his estate file for bankruptcy to eliminate the debt? Also, am I responsible for any of his bills if they are not in my name? They are primarily credit cards and medical bills. Thank you. |

| If someone owed your husband a lot of money would you want that money? Certainly you are not suggesting that you don't want to take care of legitimate debt. |

| i'm not a legal expert, but i have been executrix. if the estate has the money to pay, you have to pay. if not, the debt probably dies with the debtor -- i don't live in a community property state, might be different there. insurance proceeds paid to an individual are not part of the estate. i'm not sure about joint bank accounts. i'm guessing he didn't leave enough to pay everything -- especially since you listed medical bills. wait for more of the seniors to reply. i'm sorry for your loss. |
