Judgement Against Sister-In-LawWhat is the name of your state (only U.S. law)? CA There is a million dollar settlement against my sister-in-law. Right now she is in prison but the only thing she owns is a mobile home and the property it sits on. What we were wondering is can the court make her sell the property right away to pay towards the judgement or does the people with the judgement only have the right to put a lien against the property for when she does sell it. My husbands brother and kids are living in the home right now and he is unemployed with no where else to go and he is afarid that they will be coming to knock on the door any day now telling him he has to move and leave everything there cause it is in the house. |

| The judgement was for wrongful death and she is in prison for Elder Abuse. It is my husbands sister. |

| oh that's sad. sorry to hear that. I think the lien will be on the title and when its sold it will come up then. Go to the court clerk and ask. I'm sure it is not as serious as the inital reason she owes you guys the money. |

| California has a homestead exemption for judgments, it is $75,000 for married couples. If the residence is sold and another purchased in 6 months, the exemption follows to the new residence. Your brother should file for the homestead exemption with the taxing authority for the county so it is in place.
