What is the name of your state (only U.S. law)?
I am based in NJ and my civil litigation case is based in CA court.

I had secured a lawyer in 2005 on contingency.
I have a case pending in court for last 3+ years which the court has ordered a mediation in few weeks and trial date is set 6 months from now.
My lawyer has asked me to pursue another lawyer since he will be unable to carry on the case further. Please let me know if the lawyer can do that
and leave my case few months before trial even if mediation doesn't succeed.

He has to ask the judge, but the judge will approve it. It does happen all the time where the attorney has things come up which are unanticipated. It also happens when an attorney is all show and no go. (There are talkers and litigators.) I'm sorry, but you need to start looking for another attorney.
