Mechanic caught my truck on fire!What is the name of your state (only U.S. law)? washington. His insurance is only offering blue book which is not even close to the actual value. Can I accept the insurance $ and then sue him for negligence to enough to buy a new truck? |

| You can not get a payment and then sue ... however, you are untiled to the full replacement cost of the vehicle with a similar vehicle. That may or may not be the average retail in NADA or more depending on options. What you think it is worth or extra $$ because of the smell or all that fun you had in it does not matter ... go find a replacement vehicle that is as close as possible to your lost one and that is what you are entitled to have. Nothing more or less. |
