In very short form, Menards had given my lost cell phone to my Ex-Girlfriend, because she said she was my Girlfriend. Not a lost and found hat, but my electronic device containing personal data. I'm sure a policy or two were broken

Without knowing the company's policy on lost items, there is no way to answer your question if you had one. Sue the ex for the return of your property.

It could not matter one iota less what their policy is - breaking a private "policy" is meaningless and not an indication of negligence.

As for the OP's phone, assuming you lost it and didn't give it to a store employee, they have discharged their duty to you. Google "gratuitous bailment" (or look it up on this site, the same question comes up at least once every week), if you want more details.
