money owed


What is the name of your state (only U.S. law)? california
my brother, sisters and myself owned a warehouse which was sold about a year and a half ago. my sister has been holding the money in an account, of which i have not received any payment from that sale, but do not know where the money is. several attempts have been made to try and get my money from my sister, but not successful. what is the best approach in this matter (civil or criminal, or both). since it has now become her willful and intentional negligence and ignoring my requests, can she be liable for punitive damages as well.

Neither you nor any of your siblings have contacted the buyer recently? What have you done to try and rectify this?

not sure why i would contact the buyer. my sister has the money. all i've tried is contacting my sister, and asking for my money.

Because, m'dear, you edited your post after I responded to include the bit about your sister having the money.

But that aside, you may wish to take the bill of sale and any ownership documents and have an attorney review them to see what, if any, recourse you may have.

To recap: you all jointly owned the warehouse. It was sold a year and a half ago. Your sister sat on the proceeds. You never saw a dime. Sounds like your sister just ran off with the cash and probably spent your share.

What about the other family members? Did they receive their shares? Why not you? Were the funds at the closing made out in a check to the three of you jointly? Or did the funds go in escrow to your closing attorney, assuming you hired one? If so, why did the funds end up all in your sister's hands? Did you agree to that? There are so many loose ends here that you need competent legal advice to go sort this out.
