Motion: Change of Venue - Is this allowed based on the following:


Arizona



As a Defendant in a Civil Cause, the Trial date has been set for the
End of August, however, because of the Courts location, and my
Physical and visual disabilities (recovering from serious accident)
It's nearly impossible to get there.

After the Trial date was set, (via Teleconf) I looked into
Travel arrangments. The city has no Greyhound service, No AMTRAK services
And only a Small Municipal airport with limited small plane access.

Would the Court allow a change of Venue, within the same Jurisdiction
To a Superior Court in a Larger area that would place less of
A risk to my Physical safety while traveling. Additionally, I will have
To travel alone, so it's going to be pretty rough.

Venue is either proper or improper. Motions for change in venue are based on removing the case to the proper venue. Sometimes more than one venue is proper, but that will depend on your state's statutes. In certain cases, venue that is otherwise proper can be changed to another proper venue based on the doctrine of forum nonconviens- the inconvience to the defendant to try the case in the current venue. This is usually entirely up to the discretion of the judge. You probably need to get a lawyer on this one.
