What is the name of your state? Massachusetts

On the border of our property and our neighbor's is a maple tree that two tree companies have looked at for us and deemed rotting and hazardous. Should it fall, it threatens to fall on our drive/yard/porch. It is his tree. We offered to split costs, offered to foot the bill -- he will allow nothing.

So, if we sue -- does it start w/ a lawyer's letter? Also, in the suit is he not only forced to remove it at his cost, but also by a certain date, and if so, and he fails to do so, what is the penalty? Can we also include in the suit that not only must he remove the tree but also pay our legal fees? What's the chance of collecting?

basically, we don't want to wait for this thing to fall on our car, our son, ourselves and then collect damages. We want it down. But we don't know how even a lawsuit could guarantee that this tree would be taken down.

We want to move fast on this so all responses are appreciated !
