If a judge doesn't swear in the litigants and proceeds with questioning, does it constitute a mistrial?
Does it constitute a mistrial? No. An oath is taken in SOME judicial proceedings or in relation to SOME matters connected with judicial proceedings.

My state does not require swearing in for civil trials, only criminal. I would bet many others are the same.

What state are you in, racer72?

It depends on the court proceeding whether anybody will be sworn in or not, for both civil and criminal actions.
