Does it constitute a mistrial? No. An oath is taken in SOME judicial proceedings or in relation to SOME matters connected with judicial proceedings.

My state does not require swearing in for civil trials, only criminal. I would bet many others are the same.

It depends on the court proceeding whether anybody will be sworn in or not, for both civil and criminal actions.
