There is an absentee landlord of 2 private single room occupancy homes on my block. My block is ethnically homogenous of Central Americans who gather daily, morning to night on my block. These folks come from all over the borough and different states (even their Prime Minister came to my block) just to hang out on my block (families and droves of folks ages young to senior citizen). These men and women play bongos, sing chants, bang the table when playing dominoes, and play loud music. They buy beer and food from a tenant in this absentee homeowner's house. The Police Department is unresponsive and when they do come, their influence is never enough to send a message to these folks that they are a nuisance to those folks who own homes, who go to work, and who wish to enjoy the privacy of their/my home. I've already turned on my air conditioner to block the noise. I can't raise my window for air because then I have to hear the clacking (dominoes), the talking, and the music. These loiterers or revelers curse the neighbors for us daring to call the police to stop the madness. My neighbors witness that the cops don't issues summonses to these people for disturbing the peace and loitering on the sidewalk and making a nuisance of themselves until the wee hours of the morning. These loiterers can't say they are guests of the tenants who live in the SROs because I never see the tenants hanging out with these "guests" all day or even inviting the blocks' guests/loiterers into their tiny rooms.
I do not rest. I have fibromyalgia for which two main symptoms that plague me are pain and fatigue. I work everyday, yet I can't get a good night or morning's sleep (it's worse on the weekend) because of the noise from the loiterers' mouths, the cursing, the clacking of dominoes, the music, and utterances that reverbate like the rumble of an earthquake at 1, 2, 3 or 4 AM, and let's not forget the music from open car windows. These men curse each other and curse more and more per each beer he or even she drinks. I wake up exhausted and I border between anxiety and despondency. This has gone on for years, and Community Boards, Precinct Councils, and elected officials, can not stop this madness.
Can I take the homeowner to court and sue him? He needs to take responsibility for these people loitering on his property. He seldoms visits the block (except to collect rent) and when he does, he never tells his countrymen and country women that they can't hang out on his stoop, set up a table on the sidewalk to play dominoes, drink, etc. He claims they don't listen to him. How ironic because these folks know they cannot loiter on my property. I ask them to move and they do.
I want to send a message to the homeowner that he's responsible for my lack of sleep, my anxiety and fatigue because I can't get a good night's sleep. I'm also writing on behalf of a two tother neighors who feel the same So many of us homeowners and decent tenants are fed up. I want to go after the landlord. Can the homeowners take this man into court? May I, individually?
