| Nonsuit? What is the name of your state (only U.S. law)? VA
I am the plaintiff on a civil case which was transfered from small claims court. I had filed a small claims suit for a minor traffic accident, but the defendant's insurance company moved it to civil division in Fairfax county. Now, if I want to pursue other means (my insurance) instead of this law suit, how do I cancel to take back this suit? The trial date is already set and is about a month from now. Somebody recommended that I do a non-suit. My questions are -
1. What is the best option for me to withdraw my case? (Non-suit)?
2. What is the procedure for it? Can I do it myself or do I need a lawyer?
3. If I do withdraw my case now (before it goes to trial) can the defendant or defendant's counsel go after me for legal fees or other damages? If so, what can I do to avoid such trouble?
4. Is there a time limit before which I can withdraw the case without any consequences?
