    Remove judgmnt filed in error

    I am in Texas and when trying to purchase a home and found a judgment against me for rent that had been filed and I was never served. They won by default and now they say that it shouldn't have even been filed. They are willing to file a Release of Judgment but I am afraid it will look as if I paid off a valid judgment. My broker said it should mention it was filed in error and that a simple Release of Judgment would mean I would have to wait 25 mos before I could get a home loan. Any ideas on what I should do. This was filed in a Justice Court/ Precint suit.
