I am the plan tiff with a case for unpaid overtime due to misclassification. Defendant lawyer filed 5 motion to dismiss and was denied all. But they are trying to vacate that decision because they argue that this case should not be in small claims.
My question is how is this following procedure? I thought small claims did not allow delaying trial for numerous motions. I cannot find any information on the defendants right to appeal this denial of motion to dismiss.
