My quetion is this, I am being sued by Capitol One for a balance on a credit card that I have been paying for since 2005 through a credit counseling program. They have accepted every payment that I have ever sent to them. I have recently increased payment as some of the other creditors have been paid off so I just funnel the monies to others to pay off quicker.

Can I be sued even though they are still accepting what payment I am sending them? Do I have any leg to stand on in court?
