Summons to answer interrogatories

What is the name of your state (only U.S. law)? VA

I will be questioning someone in a summons to answer interrogatories. If the person does not have the information readily available (ie banck account info) , is she required to get it to me?

The exact wording of the statute is different in each state. Generally, you can't require someone to create something or to gain information outside of their possession or control.

But, I'm unsure of a "summons" for "interrogatories". Is this a party opponent? Are you really looking to give a deposition?

If these were written interrogatories, it would be less likely that the person could answer that they do not have that particular info.
