Living.Trust.by.excercising.its.authority.under.Probate.Code2580.et.seq..to.
substitute.its.judgment.for.that.of.the.conservatee.,and.approve.the.creation
and.funding.of.the.Trust.(2)my.brother.who.received.notice.of.the.substitued
judgment.proceedings.and.appeared.before.the.Probate.Court.to.offer.evidence
and.argument.against.the.petition.to.create.and.fund.the.Trust,is."collaterally
estpped"-i.e.,barred-from.again.challenging.the.propriety.of.the.Trust.or.its
dispositive.provisions.
The.general.integrity.of.substitued.judgment.proceedings.on.which.both.the
public.and.the.courts.rely.is.the.issue.,and.the.issue.of.collateral.estoppel.
as.one.going.to.whether.it.should.be.relitigated..The.only.problem.is.that
there.is.no.caselaw.on.point.

termination.of.the.conservatorship.and.the.substituted.judgment.and.got.it.
I.had.nothing.to.do.with.any.of.it.
If.my.brother.had.only.talked.to.me.I.would.have.shared.some.of.my.inheritance
with.him..But.he.immediately.filed.this.suit,with.these.dastardly.charges.I
can't.let.the.record.stand.and.not.respond.That.would.look.like.some.sort.of
payoff...I.have.to.defend.myself.I'm.not.greedy.I've.got.plenty.of.money.and
so.does.my.brother.
