Question

time limit on commencement on case


What is the name of your state?alabama

I filed a legal malpractice suit on my trial attorney from a criminal case, they then filed for dismissal of the case . The judge denied dismissal, but nothing is happening on the case. My civil attorney says he is waiting for the judge to set dates for discovery, but it's been months. I'm afraid the judge could dismiss the case . Is there a time limit for commencement of civil cases? I have left messages for my civil attorney about this, but haven't heard from him for weeks. My P.I. checked the files at the courthouse and saw nothing filed requesting discovery. Can this be done via phone or should there be something filed in writing? Tell me where to look this up and I'll do it.

Criminal cases take priority on a court's docket so civil cases often take a long time. Be patient.
