advice about contempt with no crime attached


What is the name of your state (only U.S. law)? va


I have a daughter who is very aggressive when she does not get what she wants. she hits us ect, One night I called the police I had it! they came got her and the issue was brought to court. charges were brought up against my daughter for assault. 6 months ago the judge ordered US to go to counseling at a center for retarded (that is what they call it not me) people. I said no way we get our counsel from the Bible. Well we have been charged with contempt. there was not even a question asked by the prosicuters just the judge.so he charged us with contempt and said he was not sighn ing the order yet but his signature is on there just not on the line. The point is he has even told us he IS going to find my daughter not guilty but he wants to string us along a bit more (his words). It will have been almost 2 years when we go to the last court date. What happened to life and liberty and having to have a trial and be able to present the evidence against someone to take his liberty away? My daughter was not in "delinquent" status.She hit ME in MY HOME. I have kept her off of the streets. now the judge says the case in unappealable because he has not passed a sentence on us . We want to fight this with our civil rights under the va. constitution and the us constitutionI pray we can do it we are lamen and need help and any advice would help. Dobbiemom

Good. You shouldn't put up with being abused by anyone.

You defied a court order, that's contempt. As part of your daughter's sentence for battery, she was ordered to counseling, and as her parents, you were ordered also. You chose not to help your daughter with her issues, therefore you are in contempt.

Not guilty to the original battery charge, or not guilty to the contempt charges? If it's for the contempt charges, I understand that. You refused to go, therefore YOU are in contempt.

Were you in the courtroom when the judge originally ordered counseling? Then you were present.

Go to the court-ordered counseling and try to help your daughter. If you take your counseling from the bible, but your daughter still battered you, then obviously the bible counseling didn't take, and more is needed. You can't just pray your daughter's problems away. You need to work through them. Otherwise, you might find that you will have more problems than prayer can help.

You do know that contempt charges can lead to jail, right?
