Common Law name changeWhat is the name of your state (only U.S. law)? Ga There is a CD being held up due to the bank not excepting common law name change. The name change is 20 yrs old. The CD was left for a friend of mine by a member of his family. He cannot claim it from the bank, even tho he has been going by his name for over 20 yrs. All of his paper work is in order. Is there a legal recourse he can take other than going to the courthouse? Is this a form of discrimination against common laws? |

| Georgia does not require private institutions to recognize common law name changes. Many government agencies also do not recognize them. He will have to legally change his name. common law name changeThe individual live in Ga, but the institution is in Chicago. Would that make much of a difference? |

| If the institution does business in Georgia, that state's laws apply. It really doesn't matter, Illinois law is the same.
