Question

discrimination, abuse, doctor's malpractice. Please HELP!!!


CA, NY.

I am an international student and I have been studying in US for 2 years aiming to get my degree. My situation is a bit complicated since I have revived from a lot of things for the last 5 months. Please consider to help and advice, please!!! cause I have to figure out what happened, I am sick of this morally and physically!

in the winter holiday, I moved from LA to NYC cause of the traffic tickets to show up to the court, which I had got a year before. That ticket suspended my driver's licenses and it caused I could not drive to campus. In the time of clearing the issues, I have got a health problem, I visited the doctor:
- he asked me for the insurance.
- I called my college to get the insurance information.
-College hardly gave me the insurance information, after totally I had to send the confirmation of all the issues.

- So, the Doctor appointed a surgery date, I was waiting for that date cause I had a car which I had to drive back to LA, I was physically unable to go myself cause of my foot problems, I had a hummer toe in my right foot and it was risky for me.

- Since I explained to the College I have problems which are beyond of my control to come back on time, I also provided the paper proofs of all issues that I had get a surgery because of my medical problems, but still they put me in two choice to come back or they will make me out of status… it seemed for me that they abusing me, and discriminating me knowing that I am an international student with totally no rights in US as not as a Resident of US, I was lost, I did not know what to do at that time, but still I had told them about this and asked their support, two different metro cities both in two different ends of the country. I decided to go to the surgery and then to figure out what to do further with my status cause I could not do anything before this.

- Since I was treated, I could not walk at all, I was in my friend's house, he was looking after me in NY for 2 month, I was visiting the doctor twice a week. But I was very depressed, I did not know what to do.. I could not walk normally for two lonely months. The doctor was sure that I will be Okay in 1 month... but it did not happen... One day, after days passed I was sleeping in my friends house, at 6:00am. the ICE (Immigration and Customs Enforcement) came and arrested me... they promised me that after making the papers they release me, but they forwarded me to the JAIL.. I was depressed so much, psychically I could not understand what is going on.. and nobody could advice me knowing my situation and my injury... my free lawyer promised me that I will be released shortly cause it is a mistake... but ICE did not release me and did not provide any respond to my arguments, they just overused their power over me.

Dear kind People, help, what should I do with my issues with my surgery where the doctor made a mistake, I can not control any of my toes, and he shortened one of them in my right foot. the education which I dreamed to receive was not completed, and the college and the government who mistreated me and abused my civil rights.. Please HELP!!!!

I have very shortly described my situation, I need a support, please help! What is that??? Thanks in advance!!!

You fled the jurisdiction to avoid traffic tickets, and were apparently somewhere your visa did not allow you to be, and you wonder why you got arrested?

I had got a speeding ticket, but it was on the process of clearing, I paid the bail and was waiting to show up to the court in NJ.. the other tickets were totally cleare. and I was in hollidays, but still my visa allows me to travel. there was no any problems with that, and also I travel a lot and none of this arguements the reason they detained me, the opent point is misconduction and the neglect and abusement of College who put on the VISA SEVP system, that I am out of status, and then ICE starts to look after. Please advice! thanks!

I don't see where you have been discriminated against, but there is evidence of abuse.

You abused our system of laws and school regulations. Where I come from it is called - you reep what you sow.

You said you have an attorney, what did he say about your situation?

I am sorry for the question, but please tell me what is that that they did with me more then discrimination, abuse, and a wrong surgery???? When the local doctors confirm that something made wrong, and the doctor who made the surgery is not sending me the medical records. Did I miss something?? or can you forward to any law to any international human rights and civil law, or even American law which can prove that they are being correct??? they did not respond to any of my arguments as I previously said, it means they just kept me as an animal. My lawyer was free, and she would not go and support me to go against these authorities who overused their power neglectly. She just helped me to document these factors and expedite them. Please advice!

First, you are not under international law. You are under the laws of the jurisdiction you were sitting in when the crimes were committed.

Discrimination is usually legal. As long as they would have treated all students with the same issues in the same way, then it would not be ILLEGAL discrimination.

Lawyers are specialized. Your immigration attorney will not file a medical malpractice suit.

I also side with the other posters. If you didn't want to be treated like a criminal, don't commit crimes.

Okay Sir, Please provide the exact points and evidiences where you see that was a crime, I was one of the best students at my college, and would plead honestly guilty if I was guilty, I was just sick and did not go to school do you think is that a crime??? or do you think paying for traffic tickets is a crime??? what do you see here as a crime???. Please help me to undestand what is my mistake that the College Officials were right to put me out of status???
