FTCA exceptions

What is the name of your state (only U.S. law)? California, Federal or State:

Can under certain circumstances 28 C.F.R. 14.2(a) FTCA requirements be waived by agency or excused by the court? which normally would require for a complaint to be filed with agency on a “Standard Form 95 or other written notification of an incident, accompanied by a claim for money damages in a sum certain for injury to or loss of property, personal injury, or death alleged to have occurred by reason of the incident”.

If there exist special circumstances that allows the injured party to institute an action against under FTCA 28 U.S.C. 2675(a),(b) ? What would be the special circumstances be that would allow the injured party not only to file but to sustain an action against the government?.
