Hippa Violation - Scripps Mercy HospitalTo whom it may concern, Hello. I am currently in the US Navy. I am currently in search of a law firm who can help me. I have spoken with attorneys these past couple of days. They say I have a case but may be too large for them. Also, some are wanting to charge me for consultation. Well keep in mind, I am only a US Navy Sailor. I’m not rich. I cant pay up front but if I do have a lawsuit, charge a certain percent out of that. Well here is my case. CASE: I was recently involved in a drugged rape case. And this is why I paid a visit to Scripps Mercy Hospital. While I was a patient. I informed my command I was being hospitalized. I was missing from a Friday to a Monday. No memory of what happened. The hospital did test and hydrated me while in the hospital. The head leiutent of medical from my ship called the hospital to get info. Hospital said “ We are sorry, we can not provide medical information about our patients. It is confidential. Patient has also request his information be confidential.” If you like you can call back when patient is better and you can speak with him and get info from him if you like. Ship doctor said ok.” Never called back. Well when test came in. It turned out my system had meth in it. One member of my department on the ship call and asked if I was ok. He said he was on his way to make sure I was. He showed up and saw me. He asked if I knew anything yet and I said yes but did not wish to disclose it with him. Every time a doctor came in. He tried to stay in the room to hear information. He was asked to leave every time. Later I come out to find out the my ship wants me onboard as soon as I am released from the hospital. I was released about 12am from Mercy Hospital and police wanted to do there own rape test at there clinic. I was released from there at about 430am. My shipmate told the officer that I needed to report to the ship after I was done there. I arrived at the ship at about 520am. Reported to our master of arms department and they asked for a urain test. I knew something was not right. They said I could wait till 7am to take there test. So I waited and reported to medical at 630am. Medical officer told me that they got information from someone that I had came out positive for meth at the hospital and that the Captain wanted his own copy of exam. I stayed wondering how that information got out to the ship. I didn’t sign or release any information to anyone. While I am with the Master of Arms one of the MA’s tells me. “Hey, why cant you pee? You got your results at the hospital right? I said yes and its none of your concern. Well then you should no that we no that you came out positive for meth. I stayed in shock wondering how they got the information. Next day I went up to medical and asked, can I ask how you got information of me being positive. Medical officer said, we don’t know. Someone told the CDO on duty that Monday. Then she tells me in a silent voice. I might have been your BM1(shipmate at hospital). I call my bm1 and ask him. “ BM1 can I ask you if you remember who disclosed information off my medical record to you at the hospital”… He stuttered and said I didn’t catch a name. I asked, do you at lease no if it was a male or female.. He stuttered again and said it was a male. I said thank you and hung up. I called the hospital and reported the incident and they said they would get to the bottom of who disclosed the information cause it clearly said on my medical record was to be confidential do to being military. They apologized. I have not heard from them since. Information was provided to my BM1 while I was still in patient care. They have clearly broken the privacy act. | Take out all of your personal information. You don't know whether someone gave him that information or he snuck and read your chart. You have no case.

| I also seem to recall that since you are a member of the military they have darn near a universal right to most anything that happens to you. It could be very likely that they can access that info from the hospital if they wanted to. Or, they could compel you to sign a release. When in the service, your life is no longer your own to a very great degree. Now, if they are all concerned with meth., I suspect they believe you were taking illegal drugs. Or, are you contending that you were drugged against your will somehow? If so, have you reported this to the police? I suspect that no matter how this turns out, your military days are numbered. - Carl
