What is the name of your state? N.J. I would like to know that after all state appellant appeals are over , what is the format to file for a federal review. In order to have a new trial. Also, can you file a federal civil action, when the conviction was obtained by conspiricy. By prosecutors, law enforcment officers. Next question is when a defendant is tried on a 4th degree crime, is that required to be tried in superiour court and is the defendant entitled to a jury trial on a charge of criminal tresspass, 4th degree. statue 2c:18-3, this statue requires that if it occured in a dwelling it will be charged as a 4th degree crime.. Defendant was charged with this offense, found guilty in a local municipal, at time of trial defendant was advised that they were being tried on defiant tresspass, yet found guilty of the higer degree charge of criminal tresspass. defendant objected on the grounds, that he was defending a lesser charge. , and was not informed as to the higer offense.
on appeal the courts refused to grant new trial. this was an inditable offense that was suppose to be downgraded to a lower court. defendant was found guilty on the original inditable charge in a municipal court without the right of trial by jury. thank you.dkshadow.
