What information can a past employer tell

What is the name of your state (only U.S. law)? Arkansas
I want to find out what action I can take against my ex-employer for giving out bad reference to a new employer.

how do you know exactly what the ex-employer told the potential employer?

Where did you get the idea that bad references are illegal? They're not.

Your employer may legally give any information that is true, that they honestly believe is true, or that represents their honest and supportable opinion.
