What is the name of your state? FL

I'm selling equipment across the U.S. manufactured by another company which is also private labeling for us. Should we be listed on their insurance policy in case of accidental failure? In other words, how do I protect myself from a liability case as we are not the manufacturer.

You need your own insurance no matter what arrangement you have with the manufacturer. You will be named singly or jointly in any lawsuit. Our company was even sued for products it turned out we hadn't even sold, but it still costs a bundle for the lawyers. Of course, you may be able to turn around and collect from the manufacturer for any losses incurred because of their negligence, but in reality you might then lose your source of supply.....and....it costs a bundle for the lawyers. :)

I would recommend to have yourself listed as an additional insured to the companies policy with respects to general liability. The company may receive a fee to do so.
