Computer Forums.


What is the name of your state (only U.S. law)? Ohio

Is it legal for the owner of a message board to modify a post to where they changed the total meaning of the post and now are benefiting from wht they changed it to. For example I put "Bob's BBQ is a good place to eat. Check it out at www.bobsbbq.com". The moderator/owner changes it to "www.edschilli.com" which he owns. If not what legal ramifications do we have as this person has been doing this since they took over the forum 1 month ago.

I have found another forum but My Name is now associated with statements I did not make since they were totally changed. The moderator should had just deleted the post if he did not like it but no he is changing my words that are posted and leaving my name still associated with it.

You will want to read the TOS of the forum. The answers to your question about what the owners of the forum can and cannot do is all there.

I read the TOS on the main page and it does not mention anything they can do.


I have saved the page in case they change it in the future.

After further reading all over the page it says post will be deleted. Nothing about editing them.

"We will not tolerate rude behavior, inappropriate posts, users who "spam" and post their comments on more than one Forum at a time, or posts that are not on the topic. These posts will be removed and repeat offenders will be banned. We want this to be an open forum where people will not be afraid to post their comments in a professional manner."

Is there anywhere that it mentions something along the lines of whatever you post becomes their property? And/or that they retain editorial control?

No


NO Not that I see. I just reread everything on the home page. It only says the will "delete" inappropriate posts. This has happened to at least 20 plus people in the last few days.

Thanks for the suggestion.


I don't feel like moving on or does any of the other people that have had this happen to them. I am wanting a legal opinion by an attorney that knows these laws as to whether we have a case, civil or criminal. We are all willing to make a stand here against the individual.

Fine, the ONLY way you will be able to do what you wish to do is with the aid of an attorney. Knowing that, here is my advice: find an attorney willing to represent you.

That, combined with the factually correct information you've already received, is the best legal advice you will gain from anybody that is not the attorney you've retained. Good luck.

Tell forum management that you will name names if the post isn't removed and the written policy revised. Also, consider contacting the website that hosts the forum, if it's a third party.

Unless any applicable law or legal decision says no, currently yes. Currently,
anyway.

You could argue copyright. But last I checked, copyrights can be contracted
to anyone, which (as Zigner hinted) some (if not all) forums indicate such.

If you really want to know if you do have some remotely enforceable claim,
only a lawyer within your area can really tell you. That is, if they're even that
familiar with things like this as it's become too specialized.

Personally, I also suggest moving on since we don't always have our way with
others, especially with things not really within our control. But...it's your call.
