Domain Name Dispute

What is the name of your state (only U.S. law)? Pennsylvania

I have a situation whereas I hired a lawyer to file a domain name complaint/dispute with ICANN, gave a retainer of 5K and saw no filing occur, no evidence of work done to file and most of the money spent without a filing. What can I do to (a) recoup losses from original lawyer? and (b) file this dispute without further problems?

I realize I will probably have to make a claim in small claims court against original lawyer but any advice on what I'll need to win would be helpful. I also realize I will need a new lawyer to file this dispute but how much should I realistically be looking to spend and what I need to get this done would be helpful.
