    online slander using someone else's name

    What is the name of your state? California

    What legal recourse does a doctor have who has found out that they have been falsely accused online of unprofessional and inappropriate conduct at work? This information was posted on a medical/doctor referral website and was posted using the identity of another medical professional known to the doctor in question. The medical professional alerted the doctor to this false posting - both of them have been wronged. Are they allowed to find out the identity of the person who posted this fase information?

    YES. You can find out someones' identity from a web site posting. HOW?, hire an attorney and file a lawsuit. A Subpoena is required to obtain anonmyous posters information. Either subpoena the site where the post appears, or the ISP, or both.

    This may be splitting hairs, but is there any difference in the eyes of the law between posting slanderous information and posting information under someone else's identity? i.e., would it be easier to prosecute someone for the latter since the former gets into issues of freedom of speech, etc., especially as it relates to the internet?
